4 months imprisonment for the owner of a decor establishment in Sohar

Sohar: The Court of First Instance in Sohar recently ruled to convict an accused of a misdemeanor of failing to properly provide and guarantee the service, and sentenced him to four months in prison with an order to stay the sentence according to the reasons for the ruling.

The facts are that a consumer filed a complaint with the General Directorate of Consumer Protection in Sohar against an institution in which he stated that he had agreed with the institution to carry out decoration, downloading, dyeing and installing stone for his house.

The owner of the establishment, however, did not move a finger, which prompted the consumer to submit his complaint to the Directorate, and in turn, the Directorate took inference procedures and then referred it to the Public Prosecution, who referred it to the competent court, and because the supplier violated the misdemeanor of not providing the service properly, which is punishable by the text of Article 23 in terms of Article 39 / of the Consumer Protection Law 66/2014, which stipulates that (the provider is obligated to provide the service to the consumer in a proper manner and in accordance with its nature, and he is also obligated to guarantee the service he provides within a period of time commensurate with its nature, and in the event of a breach of this, he is obligated to refund the value of that service or in return for what is compelled shortfall in it, or by performing it again in a proper manner, in the manner specified by the regulation) the court issued the aforementioned ruling.
