Muscat: His Majesty Sultan Haitham bin Tarik issued Royal Decree No. 23/2022 amending some provisions of the Administrative Judiciary Court Law

.The first article of the decree provided for the attached amendments to the aforementioned Administrative Court Law.

As for the second article of the decree, it stipulated the cancellation of everything that contradicts this decree and the attached amendments, or contradicts their provisions.

The amendments to some provisions of the Administrative Court Law were as follows:

The texts of Articles No. (3) and (6) of the Administrative Judiciary Court Law issued by the aforementioned Royal Decree No. 91/99 shall be replaced by the following two texts:

Article (3)

The Trial Chamber shall be formed under the chairmanship of at least a First Assistant Counsel, and the membership of (2) two members court.

Article (6)

The court shall have the exclusive jurisdiction to adjudicate administrative disputes, including the following:

1- Cases submitted by public officials to review final administrative decisions related to all their functional affairs.
2 – Cases submitted by stakeholders to review final administrative decisions.
3 – Cases submitted by stakeholders to review final decisions issued by administrative committees with judicial jurisdiction
. 4 – Cases related to salaries, pensions, rewards and the like due to public officials or their heirs.
5 – Compensation claims related to administrative disputes, whether filed in an original or subsidiary capacity.
6- Cases related to administrative contracts, without prejudice to the provision of Article (6) bis of this law.
7- Other matters in which the laws provide for the jurisdiction of the court.
The administrative decisions stipulated in Clauses (1) and (2) of this Article shall be deemed to be the administrative authorities’ refusal or failure to take a decision that they should have taken in accordance with the laws and regulations. To search for suitability
