Oman’s CPA clarifies regarding ‘Dermovate’ cream product

The Consumer Protection Authority clarified that with reference to what is being circulated on the (Twitter) platform about a cream product of the brand (Dermovit), which is circulated in some centers and commercial establishments, and according to the statement of the Ministry of Health that it is a medical product that requires a prescription and an explanation of how to use it from the pharmacist, the person may not know it for the ordinary person who works in commercial establishments

The authority would like to clarify that: Based on the text of Article (3) of the Consumer Protection Law promulgated by Royal Decree No. 66/2014, “it is prohibited to trade in any commodity or provide any service before fulfilling all conditions related to health and safety and obtaining licenses or approvals from the concerned authority, as indicated by the regulations.” And the text of Article (7): It is prohibited to trade in any adulterated, corrupt, imitated or unauthorized commodity ……… etc. And the text of Article (19) of the Executive Regulations issued by Resolution No. 77/2017: “The supplier is prohibited from the following: 1- Trading in adulterated, spoiled, imitated or unauthorized goods … etc. And the text of Article (21) of the executive regulations amended by Resolution No. 1/2022:

“The provider is prohibited from trading in any commodity or providing any service before fulfilling all health and safety conditions stipulated in the relevant laws, regulations and decisions … etc. Accordingly, if it is proved that the supplier in the market traded a cream product of the brand (Dermovit) without adhering to what was stated in the legal texts mentioned above, then it is considered a violation of the Consumer Protection Law and its executive regulations and amendments, which poses a threat to the health and safety of the consumer.
